Government Permitting

The Government Permitting Process is an intricated process, since a number of different Chinese Government Departments, are involved in regulating and supervising a construction project. In addition to the Laws and Regulations set by the Central Government, the different provinces and local governments have bylaws and regulations applicable to the construction projects within their jurisdictions.

This means that for each construction project a tailored Government Permitting Map has to be prepared, based on the local regulations and requirements.

The approval process generally includes 7 stages according to a standard project lifecycle for a new-build and Client-owned project. Other processes will apply for leasing, upgrading, extension and fit-out projects:

1. Business License;

2. Land Certificate;

3. Project Approval;

4. Design and Construction Planning License;

5. Construction License;

6. Completion and Acceptance;

7. Property Ownership Certificate;

Each of the stages consists of various steps and various application reports of which some must be prepared by licensed 3rd parties f.e.:

• Environment Impact Assessment Report (Form) – EIA;

• Feasibility Study Report and Project Application Report – FSR or PAR;

• Energy Saving Assessment Report - ESA;

• Safety Assessment Report - SA;

• Occupation Disease Protection Report - ODP;

Because of the complexity of the Government Permitting Process and the variations in the local requirements it is easy to make a mistake in the application process which can have serious consequences resulting in delays and an additional cost or even fines.
